Overview

Analysis Group has significant experience managing large-scale, complex litigations across all areas of finance. We have worked on cases involving valuation, securities litigation, market manipulation, and insider trading. Our experts have given evidence in a number of European venues, including the UK High Court of Justice, the Autorité des Marchés Financiers (AMF) in France, and courts in France, Belgium, and the Netherlands. Our global teams are drawn from across our offices in Europe, North America, and Asia.

Focus Areas

Valuation

Analysis Group consultants have deep experience valuing companies, financial instruments, and other assets using discounted cash flow, comparable company and other standard valuation approaches. These valuations are often used to assist counsel and clients in developing and negotiating settlement frameworks. We have served as experts in valuation cases in the UK High Court of Justice, French commercial courts, the Dutch Enterprise Chamber, and other European litigation venues in cases involving insolvency, restructuring, and post-transaction disputes, across many industries.

Securities Litigation

Analysis Group teams have worked on numerous matters involving allegations of securities fraud and improper accounting treatment. The engagements include Financial Services and Markets Act 2000 Section 90/90A cases in the UK High Court of Justice, as well as cases in Dutch, German, and Belgian courts. Our experts and consultants have evaluated the materiality of alleged misstatements and analyzed investors’ reliance on such alleged misstatements. Across numerous cases, we have relied on event studies and other valuation techniques to measure the impact of alleged misstatements and omissions on securities prices to estimate the quantum of damages. We have also assisted clients across jurisdictions with developing settlement frameworks, allocating settlement amounts, and supporting settlement negotiations. 

Market Manipulation

We have analyzed allegations based on investment recommendations, communications from issuers, or suspicious transactions. This includes analyzing large volumes of oral and written communications to systematically detect various types of contentious information or statements, classifying the topics addressed, and quantifying the communication; we have also calculated the actual or potential impact of these communications on stock prices. In other cases, we analyzed high-frequency transactions and compared transactions in one market with transactions or positions in derivative markets to determine whether manipulation (spoofing, cornering/squeezing, etc.) could be determined or whether other explanations should be considered.

Insider Trading

We have examined whether transactions by executives prior to the publication of news were tortious, analyzing a priori whether the news was likely to influence the issuer's stock price and, a posteriori, whether it had an impact on the stock price. We have also prepared expert reports for regulators on the relevance of certain accounting information.

Dr. Van Audenrode is an expert in data analysis and econometrics, labor economics, antitrust and competition policy, and public economics. He has consulted to clients - including law firms and government agencies - in Canada, the US, and Europe. Dr. Van Audenrode’s work includes developing a methodology to value desktop software; he also developed expertise valuing goods as varied as restaurant franchises, executive stock options, or smartphone features. His recent work in public economics includes evaluating the economic rent from hydroelectricity to the Canadian economy and the value of logging rights on the ancestral territory of a Canadian First Nation. In the area of labor economics, his work has included filing an expert report assessing fair compensation for Quebec provincial judges and Quebec prosecutors and advising Quebec’s commission on pay equity. Dr. Van Audenrode has filed expert reports in courts in the US, Canada, Belgium, Germany, France, and the Netherlands, and has testified in Canada and the US. He recently filed a report with the Amsterdam Court of Appeal in support of the settlement reached between Ageas and claimant organizations in the Fortis case, the largest settlement ever reached through the Dutch Collective Settlement Act (WCAM). Dr. Van Audenrode’s scientific research and articles have been published in numerous peer-reviewed academic journals and trade journals. He is a coauthor of the book The Mutual Fund Industry: Competition and Investor Welfare, and is a frequent presenter at industry and academic conferences.

Chris Feige

Chris Feige

Principal

Mr. Feige specializes in the areas of finance, securities, and financial markets. He has worked on and managed a range of securities and valuation projects in the UK and Europe. Mr. Feige has been appointed as expert in Dutch court to provide valuation and securities claims reports in support of Steinhoff’s global securities settlement, and gave evidence in the Dutch Enterprise Chamber regarding the valuation of Getir. He has also managed teams evaluating shareholder reliance and disclosure materiality and estimating counterfactual share prices in UK Financial Services and Markets Act (FSMA) Section 90A litigation matters. Mr. Feige has supported experts analyzing the volume of false and spam accounts on Twitter, Twitter’s information security infrastructure, Twitter’s data privacy and compliance with a US Federal Trade Commission (FTC) consent decree, and share price and valuation issues on behalf of Twitter in Twitter v. Musk in which Elon Musk eventually purchased Twitter at his initial offer price. In cases involving alleged market manipulation in the foreign exchange (FX) and IBOR markets, he has analyzed trade data and evaluated alleged manipulation strategies. Mr. Feige worked on USA v. Richard Usher, et al., and the Foreign Exchange Class Antitrust Litigation, analyzing FX trade and chat data, as well as competition issues; preparing experts for testimony at trial; and providing data analyses and consulting support to counsel throughout the projects. He has also worked on a range of international arbitration cases, including valuation, damages, and competition analyses. In addition, he has developed complex valuation models, including discounted cash flow models, and analyzed asset-backed securities, collateralized debt obligations, and other securitized products in support of expert testimony in a number of bankruptcy and damages matters. Mr. Feige has also worked on a number of international arbitrations valuing defaulted sovereign debt, expropriated oil fields, and retail operations. His work has been published in several industry journals.

Devin Reilly

Devin Reilly

Vice President

Dr. Reilly specializes in the application of economic and financial analysis to litigation, regulatory investigations, and consulting efforts in a range of areas, including antitrust and competition, finance and securities, class certification, and intellectual property (IP). He has conducted economic analyses and led case teams in support of academic and industry experts. Dr. Reilly’s antitrust and competition case work includes analyzing market definition and competitive effects, two-sided markets, damages, and class certification, as well as supporting parties’ compliance with merger and investigative requests. His experience also includes analyzing lost profits, reasonable royalties, and commercial success in IP cases; evaluating materiality of disclosures in securities litigations; supporting industry experts in financial services matters; and analyzing class certification in technology, finance, and other industries. Dr. Reilly has worked on behalf of both the US government and prominent firms in industries such as technology, telecommunications, e-commerce, financial services, pharmaceuticals and medical devices, and manufacturing. His research on corporate governance, innovation and entrepreneurship, and public economics has been published in The Review of Financial Studies, among other publications. He currently serves as the Young Economist Representative for the American Bar Association’s Antitrust Magazine. Dr. Reilly received the Joel Popkin Graduate Student Teaching Prize in Economics and the Lawrence Robbins Prize in Economics, both from the University of Pennsylvania.

Hugues Dastarac

Hugues Dastarac

Dr. Dastarac has an extensive background in economics and specializes in finance and insurance. He has managed cases involving valuation, damages, market manipulation, and has contributed to several bankruptcy cases. His work has spanned sectors such as financial institutions, crypto assets, telecommunications, and energy. Prior to joining Analysis Group, Dr. Dastarac worked at a major public-sector research and policy institution, where he studied securities, derivatives, commodities and energy markets, and monetary policy and its implementation. He was also a supervisor at ACPR, the French Prudential Supervision and Resolution Authority, where he monitored insurance companies and worked on accounting reforms. Dr. Dastarac is an affiliate professor of finance at École Polytechnique.

Elena Nota

Manager

Ms. Nota specializes in applying economic and financial theory to merger-related questions and complex litigation primarily in matters involving securities and finance, antitrust and competition, and intellectual property (IP) infringement. Her work has included assessing competitive effects faced by merging parties in different jurisdictions, valuing claims in the context of securities litigation matters and settlement discussions, and evaluating whether IP licensing rates are FRAND-compliant. Ms. Nota has also completed a secondment as an economic advisor to the UK’s Competition and Markets Authority.
